This Privacy Policy explains how Axul Solutions LLC, a Wyoming limited liability company operating as David Agent("David Agent," "we," "our," or "us"), collects, uses, shares, and protects personal data in connection with our website and our AI-powered conversational agent services (the "Services").
David Agent is a business-to-business (B2B) service. We build, configure, and operate AI agents on behalf of our business clients ("Clients") so those agents can answer questions, book appointments, and support the Client's own customers ("End Users") across channels such as website chat, WhatsApp, Instagram, Facebook Messenger, and voice.
1. Our role: controller vs. processor
Depending on the data involved, we act in one of two roles:
- As a controller for the data of our Clients and website visitors: account details, billing information, and data collected on davidagent.co.
- As a processor for End User conversation data. When you chat or speak with an AI agent deployed for one of our Clients, that Client is the controller of your data, and we process it on their behalf and under their instructions. If you are an End User and want to exercise privacy rights over a conversation, please contact the business you interacted with; we will support them in fulfilling your request.
2. Information we collect
Client account data
- Name, business name, email address, and phone number
- Billing details and payment records (payments are handled by a third-party payment processor; we do not store full card numbers)
- Business materials you share with us to train your agent, such as your website content, FAQs, price lists, and service descriptions
Website enquiry data
- When you submit the demo request form on our website, we collect the first and last name, business email address, business name, and message you enter.
- That form is processed by Formspree. When you submit it, Formspree receives the information you enter and may also process limited technical data (such as IP address and device or browser information) to deliver the submission to us and help prevent abuse.
End User conversation data
- Messages exchanged with the AI agent, and voice recordings or transcriptions for voice interactions
- Contact details an End User chooses to share during a conversation, such as name, email address, or phone number (for example, to book an appointment or request a follow-up)
Technical and usage data
- IP address, browser and device type, timestamps, and session identifiers
- Aggregated usage metrics, such as conversation volumes shown in the Client dashboard
Integration data
- When a Client asks us to connect third-party tools (for example Shopify, Google Calendar, Outlook, Zoho Mail, Calendly, or Airtable), we process the data needed for that integration to work, such as calendar availability or order details.
3. How we use information
- To provide, operate, and maintain the Services, including generating AI responses to End User messages
- To set up, train, and continuously improve each Client's specific agent using the business materials the Client provides
- To carry out actions the Client has configured, such as booking appointments, capturing leads, or creating records in connected tools
- To provide Clients with dashboards and analytics about their agent's conversations
- To bill for the Services, including metering conversation volumes
- To secure the Services, prevent abuse, and comply with legal obligations
- To respond to enquiries submitted through our website and follow up about a possible engagement
- To communicate with Clients about their account, and, with consent where required, send marketing communications
We share conversation content with the AI infrastructure and model providers we rely on only for the purpose of generating responses and operating the Services. We process personal data as necessary to perform our contracts, to pursue our legitimate interests in operating and securing the Services, with consent where required, and to comply with legal obligations.
4. How we share information
We do not sell personal data. We share it only as follows:
- With our Clients:conversations an End User has with a Client's agent, including any contact details shared, are available to that Client — the End User is talking to that business.
- With service providers: vendors that provide AI processing, cloud hosting, payment processing, website form processing (Formspree), and similar infrastructure, bound by contractual data protection obligations and only to the extent needed to provide the Services.
- With integrated third parties:when a Client connects a third-party tool, relevant data flows to that tool under the third party's own terms and privacy policy.
- For legal reasons: when required by law, legal process, or to protect the rights, safety, or property of David Agent, our Clients, or others.
- In a business transfer: in connection with a merger, acquisition, or sale of assets, subject to this Policy.
5. Data retention
- Conversation data: chat logs and call recordings are automatically deleted 90 days after the conversation date. Aggregated, non-identifying analytics may be retained longer.
- Client account data: retained for the duration of the service relationship and for a short period afterward for data export, billing, and legal purposes.
6. Security
We protect personal data with industry-standard measures, including encryption in transit (TLS) and at rest (AES-256), role-based access controls, and the principle of least privilege for systems that handle customer data. No method of transmission or storage is 100% secure, but we work continuously to protect your information.
7. International transfers and hosting
Our infrastructure offers hosting in the United States and the European Union (Frankfurt, Germany). Where personal data is transferred across borders, we rely on appropriate safeguards such as Standard Contractual Clauses. Our data-handling practices are designed to support our Clients' GDPR obligations, including data processing agreements upon request.
8. Your rights
Depending on where you live, you may have rights to access, correct, delete, restrict, or port your personal data, to object to certain processing, and to withdraw consent. To exercise these rights:

- End Users: contact the business whose agent you interacted with; they control your conversation data, and we will assist them in responding.
If you are in the European Economic Area or the United Kingdom, you also have the right to lodge a complaint with your local data protection authority.
9. Google user data
Where a Client connects Google services (such as Google Calendar), our use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. Google user data is used only to provide the requested functionality (for example, checking availability and booking appointments) and is not used to develop, improve, or train generalized AI or machine-learning models.
10. Cookies
Our website uses essential cookies needed for the site to function, and may use analytics tools to understand how visitors use the site and improve it. You can control cookies through your browser settings.
11. Children
The Services are intended for business use and are not directed to children under 13 (or the equivalent minimum age in your jurisdiction). We do not knowingly collect personal data from children. If you believe a child has provided us personal data, contact us and we will delete it.
12. Changes to this Policy
We may update this Privacy Policy from time to time. Material changes will be communicated to Clients by email or through the Services. The "Last updated" date above reflects the latest revision.
